The opinion of February 10, 1993 is withdrawn and the following is substituted therefor. The issue presented is whether mandamus should issue to direct the trial court to vacate its post-verdict order granting death penalty discovery sanctions based on pretrial discovery abuse and trial misconduct. We hold that the trial court abused its discretion and that Relator has no adequate remedy by appeal; thus, we conditionally grant the writ and direct the trial court to vacate its death penalty sanction order.
