John McClanahan (McClanahan) originally filed suit against Remington Freight Lines, Inc. (Remington), and Richard Barbour, Remingtons safety director.[Footnote 1] McClanahan, who was employed as a truckdriver, claimed that Remington wrongfully discharged him in retaliation for his refusal to violate Illinois law by driving his truck through the state with a load greater than the statutory maximum 73,280 pound weight limit. Upon appeal of both parties motions for summary judgment, the Indiana Supreme Court held that McClanahan did possess a cause of action for retaliatory discharge, though he was an employee-at-will and was hired for no specific time period. McClanahan v. Remington Freight Lines, Inc. (1988) Ind., 517 N.E.2d 390 (hereinafter, McClanahan II).[Footnote 2]
